bookntrack — Terms of Service

Introduction

Welcome to bookntrack ("Company", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our software-as-a-service platform that enables photographers and studios to manage bookings, customers, orders, staff and related business operations (the "Service"). By registering for or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

• The Service is intended for professional photographers, studios and their authorised staff ("Users").
• Users must provide accurate, current and complete information at registration and keep it up to date.
• Account owners are responsible for all actions taken under their organisation account, including actions by staff they invite or authorise.
• Keep your login credentials secure and notify us immediately of any unauthorised access.

2. Description of the Service

bookntrack offers a SaaS product that includes booking and calendar management, customer relationship management, order tracking, reporting, PDF invoicing, staff access management, and related features. We may add, modify, or remove features and integrations over time.

3. Plans, Trials, Subscriptions & Payments

• We offer subscription-based plans and a 14-day free trial with full features. Trial eligibility and length are determined by us and may change.
• After the trial, continued access requires payment of the applicable subscription fees. All fees and pricing are displayed on the Site and are subject to change.
• Payments are processed via third-party payment processors. By subscribing you authorise us and our payment partners to charge your chosen payment method for recurring fees, taxes and other applicable charges.
• Refunds: Because the Service is digital and access is granted immediately, fees are generally non-refundable except where required by applicable law or in cases of demonstrable service failure solely attributable to bookntrack. Refund requests (where permitted) will be reviewed case-by-case.

4. Use of the Service & Prohibited Conduct

• Use the Service only for lawful purposes. You must not use the Service for illegal, fraudulent, abusive, or harmful activities.
• Prohibited actions include: attempting unauthorised access to other users' accounts or data, reverse engineering, scraping, reselling the Service without permission, uploading malicious code, sending spam, or otherwise interfering with the Service.

5. Intellectual Property

• We retain all rights, title and interest in and to the Service, including all software, trademarks, logos, user interface designs, documentation, and other intellectual property.
• Users retain ownership of their own uploaded content and data. By uploading data you grant us a limited, worldwide, non-exclusive licence to host, store, display and transmit that data to provide the Service and to improve it (e.g., for analytics and troubleshooting).

6. Data, Security, Backups & User Responsibility

We implement reasonable technical and organisational measures to protect user data (encryption in transit, access controls, vulnerability management). However, no system can be guaranteed 100% secure.

• User responsibility: Users are responsible for maintaining their own backups and copies of critical business data. You should regularly download booking reports, invoices, and exports as needed.
• No liability for user-side loss: bookntrack is not liable for data loss caused by user actions, device failure, user-configured integrations, third-party services, or events beyond our control (including but not limited to malware, theft, or negligence).
• Data recovery assistance: Where technically feasible we may offer data recovery services at our discretion. Such assistance may incur a reasonable service fee which will be communicated prior to any recovery work.
• Data hosting: All user data is hosted on Hostinger servers in India unless otherwise notified.

7. Availability; Maintenance; Interruptions

The Service is provided "as is" and "as available". We strive for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance or unscheduled updates. We will endeavour to provide notice of planned downtime where practicable. We are not liable for loss of business, profits, or data due to downtime.

8. Suspension, Termination & Discontinuation

• We may suspend or terminate user access for violation of these Terms, suspected abuse, fraud, or non-payment.
• Users may cancel subscriptions at any time via account settings; cancellation prevents future charges but does not automatically entitle the user to refunds for amounts already billed.
• We reserve the right to modify, suspend or discontinue the Service (or parts of it) at any time. If the Service is discontinued, we may delete or anonymise user data after reasonable notice and in accordance with our data retention policy and legal obligations.

9. Third-party Services & Integrations

The Service may integrate with third-party services (payment gateways, email providers, analytics). Those services are governed by their own terms and privacy practices. We disclaim liability for third-party actions or failures.

10. Indemnity

You agree to indemnify, defend and hold bookntrack and its affiliates harmless from any claims, liabilities, losses, damages, and expenses arising from your use of the Service, your data, or your breach of these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, bookntrack's aggregate liability arising out of or in connection with these Terms shall be limited to the fees paid by you to bookntrack in the three (3) months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages.

12. Amendments to Terms

We may amend these Terms at any time. Material changes will be posted on our website and where practicable notified by email or in-app notice. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. We recommend periodically reviewing these Terms; historic versions will be retained by us.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. The courts at Sultanpur, Uttar Pradesh shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

bookntrack — Privacy Policy

Effective Date: 1 November 2025

1. Introduction

bookntrack respects your privacy and is committed to protecting personal data in accordance with applicable laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. This Policy explains what personal data we collect, why we collect it, how we use it, and your rights.

2. Data We Collect

• Account information: name, email address, phone number, business/studio name, role.
• Operational data: bookings, customer contacts, orders, event details, uploaded media and files, notes.
• Billing data: subscription plan, invoices, limited payment metadata (we do not store full card details).
• Technical data: IP address, device/browser information, usage logs, crash reports.

3. How We Use Data

• To provide, maintain and improve the Service.
• To process payments, invoices and billing related communications.
• To send system notifications, security alerts and important service announcements.
• For analytics and product improvement (aggregated and anonymised where possible).

4. Data Sharing

We do not sell personal data. We may share data with:

• Service providers and vendors (payment processors, hosting providers, analytics) bound by confidentiality and data protection obligations.
• Law enforcement or government authorities when required by applicable law or court order.

5. Data Security

We adopt industry-standard security measures to protect data, including encryption in transit, access controls and monitoring. Despite these measures, we cannot guarantee absolute security. Users should exercise caution, use strong passwords, enable MFA where available, and maintain backups.

6. Data Retention

We retain personal data for as long as needed to provide the Service, comply with legal obligations, resolve disputes and enforce agreements. On account deletion we will delete or anonymise personal data within a reasonable timeframe except where retention is required by law.

7. Your Rights

• Access and correction: You may request access to and correction of your personal data.
• Export and deletion: You may request an export of your data or deletion of your account subject to legal retention requirements.

8. Cookies & Tracking

We use cookies and similar technologies for session management, analytics and to improve user experience. You can manage cookie preferences via your browser; disabling cookies may impact functionality.

9. Children

The Service is not directed to children under 18. We do not knowingly collect personal data from children.

10. Changes to this Policy

We may update this Privacy Policy periodically. Material changes will be posted on our website and where practicable notified by email. Continued use after changes constitutes acceptance.
